If two people are not married who gets custody?

What if they live in different cities/states and are not getting along with each other? Can I choose to just go live with one or the other?If two people are not married who gets custody?
Typically the courts tend to award the mother custody (about 90% of the time involving a child under the age of consent if memory serves Me right). But most states give the judge the final say so over it and usually if the child is of an age to be able to determine which parent they would like to live with (12 in most states), as long as there is no safety issue, the judge goes along with their wishes.If two people are not married who gets custody?

Have your parents went to court and do they have a custody order in place?


Without your parents going back to court it would be up to your parents and any court order that is in place.


If your parents go back to court the judge will ask your opinion on where you want to live.

it really depends on how old you are. i believe you still have to go through the court system. but usually the other parent will agree if they see that living there is making you unhappy. i think 16 is the age where you can chose for yourself.
In most situations its the mother but depending on how old the child is and who is more stable to take care of the child.
Anyone over the age of 11 can speak to the judge to live with whichever parent that they want to. barring drugs or abuse , of course.
custody always depend on who is more resposible to take care of the child, you 2 should discuss the issue
