Getting married with an American citizen under a tourist visa is allowed?

I'm Brazilian and have a 5 years tourist visa. I'm planning on getting married with my American boyfriend and I would like to know how to do it? If we get married what do I have to do do get permission to stay in the US?Getting married with an American citizen under a tourist visa is allowed?

If you are already in the US on a tourist visa, and then decided on the spur of the moment to get married and stay, then it would be legal to apply for a greencard.





However, it is ILLEGAL to enter the US on a tourist visa with the only intention of staying in the US by marrying a US citizen. Where it becomes tricky to marry and stay on a visitor visa is proving your intentions on entry into the US. If you can sufficiently prove to USCIS that when you entered the US, you had every intention of just visiting and returning to your country, but decided to get married while you where here, then its possible to receive a greencard. If it is denied though, you have no chance to appeal the decision. If you choose to go this route, I strongly suggest you see an immigration lawyer to advise you.





Your best bet is to either come the the US, marry your fiance, then return home and wait approval of a spouse visa. Or file for a Fiance Visa then come to the US and marry and stay.

After the marriage you have to file for AOS (adjustment of status) and the two of you will receive in about 6 months a year a notice to appear for an interview at your local immigration office. Make sure you collect a lot of evidence of your life as a couple (pictures, emails, joint bank accounts ect) cause they wanna see them all! At the same time you apply for AOS you can apply for a temporary work permit if you want to work while you wait for the greencard. Once you get the greencard you are considered a permanent resident and you can work and travel outside the US without visa. You will become a citizen after 3 years of marriage. My suggestion is that you become a citizen of the united States if you are going to be staying there. I suggest you get married first, then apply for citizenship. (having a spouse who is a citizen makes it easier) The process may take a while and will cost you some money in processing fees. You will also have to pass some basic test, but it will be well worth it ^_^. this site tells you all about becoming a citizen.Another common way is many foreigners come under the I-120 student visa, get involved in a relationship with an American citizen, then apply for a change of status to an F-1 fiance visa or even get married and apply for permanent residency, after which time you can become a citizen. There is also a lottery that the INS offers where a certain amount of people from each area ';wins'; their citizenship.
You can get married even when you are illegal in this country, as long as you entered USA legally. In your case, if you have a visa (no matter it's expired) you can apply for an adjustment of your status, it takes about 2-3 months since you start the process of paperwork.
